In April 2021, the Supreme Court established a TCPA "autodialer" definition that was highly favorable to businesses. However, an ambiguous footnote in the unanimous decision offered TCPA plaintiffs a chance to muddy the waters of what should have been a clear and sparkling stream of litigation success. This Compliance Coffee Break summarizes the Supreme Court's "autodialer" standard, explains the footnote confusion, and examines how courts nationwide have responded to plaintiffs' efforts to get the tail of the footnote to wag the dog of the opinion.
